Most people do not realize they are not being paid correctly under the law because everyone else in the company is paid the same way. The Fair Labor Standard Act (FLSA) provides a remedy for employees who are not being paid correctly, especially in regards to overtime. Many times employers classify employees incorrectly resulting in significant damages for lost overtime pay.

Simply stated, if you are not a manager who supervises two or more employees and you perform work for a company, absent some particular exemptions, you are supposed to be paid overtime (time and 1/2) for any hours worked in excess of 40 a week. Simple examples are as follows:

A bank teller or other office employee who is paid straight salary for all hours but is not a supervisor or manager.

An oilfield worker who is paid a salary or flat rate and bonuses, but works in excess of 40 hours a week.

An hourly worker who performs tasks or has to attend meetings "off the clock" on a regular basis.

A truck driver whose duties involving driving trucks with a GVWR of less than 10,000 pounds each week.

A paralegal who is not a supervisor or manager and is paid a salary and works more than 40 hours a week.
